Privacy Policy

1. About Your Privacy.

This Privacy Policy applies to the websites operated by CV Therapeutics, including www.cvt.com, www.ranexa.com, www.lifeheart.com and www.cvdcompendium.com (collectively, the "CVT Sites"). Any references in this Privacy Policy to "CV Therapeutics", "CVT", "we", or "us" means CV Therapeutics, Inc. The CVT Sites present health and medical information that, while not a substitute for medical advice or care, may benefit patients and their families. You may have an opportunity while visiting the CVT Sites to provide us with information about yourself or someone else. CVT is committed to protecting the privacy of any information we collect about or from each user who visits its websites in accordance with this Privacy Policy. This Privacy Policy informs you about how we treat any personal information that you provide to us or that we collect in the course of your use of the CVT Sites. This Privacy Policy describes what information we may collect from visitors to the CVT Sites, how we use and disclose this information, how we protect it, and what choices you have on how the information is used.

Please note that the CVT Sites are intended for the exclusive use of residents in the United States of America. It is not our intent to gather personal information from individuals residing outside the United States. The type of personal information, the manner in which it is collected, and the specified uses of the collected information may not be legal in certain countries outside of the United States. Because of these various laws, regulations, and medical practices, information designated to be used in one country may not be approved for use outside that country. Therefore, collection of personal information on the CVT Sites may not be appropriate for residents of other countries. THE CVT SITES ARE DESIGNED TO COMPLY WITH THE LAWS AND REGULATIONS OF THE UNITED STATES ONLY. Nothing on the CVT Sites should be considered a solicitation or promotion for any product or an indication for any product that is not permitted by the laws or regulations of the country where the user of the CVT Sites resides.

Please be sure to read this Privacy Policy before using and submitting information on any of the CVT Sites. Your use of the CVT Sites is subject to this Privacy Policy as well as the Terms of Use. By accessing and using the CVT Sites, you agree to be bound by the terms of this Privacy Policy and the Terms of Use.

We understand and respect that your privacy is important to you. CVT shall use and share personal information that you provide online through the CVT Sites only in the ways we tell you in this Privacy Policy or at the time you provide the information. This Privacy Policy applies to personal information (as defined below) and health-related personal information (as defined below) collected from or through the CVT Sites, including emails sent through the CVT Sites. Please note that this Privacy Policy does not apply to personal information collected from other resources and communications, such as offline surveys, phone conversations, or email messages that are not sent through the CVT Sites. This policy also does not apply to third-party websites to which the CVT Sites may link and where CVT does not control the content or the privacy practices of those sites.

2. Personal Information and Health-Related Personal Information.

The term "personal information" as used throughout this Privacy Policy, applies to any information or set of information that identifies an individual, or that is or can be used by or on behalf of CVT to identify or contact an individual. You can generally visit the CVT Sites without registering or revealing any personal information. However, in order to access certain options and services, we may ask you to provide personal information; and without providing such personal information, you may be unable to access certain options and services. We (along with our third-party partners engaged to provide marketing and advertising or other services on our behalf) collect personal information about you, only if you voluntarily provide it to us; and you have the option not to provide any personal information to us.

The term "health-related personal information" as used throughout this Privacy Policy shall apply when personal information is combined with any information on that individual's health or medical status. For purposes of this Privacy Policy, the term "personal information" includes health-related personal information.

3. Use of Personal Information and Health-Related Personal Information.

Once you voluntarily provide personal information and/or health-related personal information to us, CVT may use this information to respond to your requests for material and may use this information to contact you. CVT may use the information to provide you with materials about CV Therapeutics or our products and services, including new content or services at the CVT Sites. CVT may provide you with these materials by phone, mail, facsimile, or email. From time to time, CVT may refer to your personal information and health-related personal information to better understand your needs and how we can improve the CVT Sites, our products, and services. CVT may also enhance or merge your personal information and health-related personal information with data obtained from third parties for the same purposes. CVT may also request that you provide us with demographic information or other information that CVT may use to help us serve you better. CVT reviews personal information and non-identifiable information not only to provide the requested information and services, but also to develop and offer additional services and communications that we believe our customers might find of interest. CVT also may use personal information to audit its resources for compliance and security purposes. CVT may also share your information with third parties as set forth below in the rest of this Section 3 (Use of Personal Information and Health-Related Personal Information) and in Sections 5 (Access by Third Parties and Affiliates), 6 (Disclosure for Legal Reasons), and 8 (Consolidation of Data) of this Privacy Policy.

The following outlines specific examples of the categories of personal information and health-related personal information that you may voluntarily provide to us and how we use it:

a. Site registration: Personal information may be obtained from you on the registration forms used to process your requests for services and information, such as contact information (e.g., name, address, email address, etc.), password, username or code, age, date of birth, gender, ethnicity, and medical condition. This registration information may also be gathered if you register for certain services available on the CVT Sites via email sent from the CVT Sites. CVT may use the personal information and health-related personal information to send you a welcoming email, to verify your username and password, to send you website updates, special offers, or notices regarding relevant medical conditions and treatment, or to send you any other information responsive to the data that you provide to us. Additionally, CVT may refer to your personal information to better understand your needs and how we can improve the CVT Sites.

b. Surveys: If you choose to participate in interactive services through the CVT Sites, such as surveys and questionnaires, you may disclose health-related personal information, as well as personal information, that could be used to identify you or your family members. CVT will collect the information you may choose to disclose and analyze it to discover new facts that could help us better understand how our products are used in coping with the diseases for which they are marketed. In addition to health-related personal information (e.g., medical condition), personal information will be obtained from you on the surveys, such as contact information (e.g., name and shipping address), demographic information (e.g., zip code, age, gender, etc.), and other information (e.g., professional credentials, hobbies and interests, etc.). CVT may use this personal information and health-related personal information to provide you with information and services for which you have expressed an interest or which you may find useful based on your answers in the survey. Additionally, CVT may refer to your personal information and health-related personal information to better understand your needs and how we can improve the CVT Sites.

c. Newsletters and Email Updates: Personal information will be obtained from you from your request to subscribe to a newsletter or email updates, such as contact information (e.g., name and email address). CVT may use this personal information to deliver the newsletters or email updates that you have elected to receive.

d. Publications and Reprints: Personal information will be obtained from you from your request to receive a publication or reprint materials, such as contact information (e.g., name, address, phone, facsimile, email address, etc.) and billing information (e.g., credit card account number and account number for shipping services). CVT may use this personal information to deliver the publication or reprint materials that you have elected to receive. In addition, CVT may use the contact information for other internal business purposes.

e. Investor Information: Personal information will be obtained from you from your request to receive investor information, such as contact information (e.g., name, address, phone, facsimile, email address, etc.) and billing information (e.g., account number for shipping services). CVT may use this personal information to deliver the investor information that you have elected to receive and for other internal business purposes.

f. Career Center Employment Applications: In order to access services at the Careers at CVT site (located at www.cvt.com), you will need to register and establish a user account. Personal information (e.g., name, mailing address, email address, phone number, password, educational and employment history, and certain other demographic information) may be obtained from you when you establish a user account, and through the online application process of submitting your resume, cover letter and application for employment at CVT. Certain personal information requested at the Careers at CVT site is required - in other words, you must provide the requested information in order to fully access the services provided at the site. Other personal information requested at the Careers at CVT site is optional - in other words, you are not required to provide the requested information in order to fully access the services provided at that site. We may use this personal information to process your application for employment at CVT, to send you information regarding new open positions that may match your interests, to provide relevant information about you in submitting reports to the federal government, and as otherwise required by law. We may use and share the information in other ways that we determine are appropriate or necessary for the purpose of employee recruitment, including without limitation to contact you for follow-up and contact previous employers, educational institutions, or references you submit to verify education or prior employment, or to obtain feedback about you. If you are employed or retained by CVT, all of the personal information collected during the recruitment process shall no longer be subject to the terms of this Privacy Policy.

g. Correspondence on CV Therapeutics' Products: You may use the CVT Sites to send an email to ask questions or report problems regarding our products. You may be redirected to our third-party healthcare professionals hired by CVT to address consumers' and healthcare professionals' questions regarding use of our products. If you communicate with or request information from CVT, they will have your email address as well as whatever health-related and/or personal information you chose to include in your email. If you are reporting a product experience, we may ask you for specific facts, including patient initials, age, gender, and prescribing physician. Federal regulations require us to collect patient-identifiable information in order to file reports with the Federal Food and Drug Administration regarding the safety of our products, and as otherwise required by law. CVT may also use the information to contact the prescribing physician to follow-up regarding an unexpected event involving the use of our product. Additionally, CVT may refer to your personal information and health-related personal information to better understand your needs and how we can improve the CVT Sites.

h. General Correspondence: CV Therapeutics welcomes email inquiries and comments from visitors to the CVT Sites. Personal information will be obtained from you when you submit such inquiries and comments to CVT, such as contact information (e.g., email address), as well as any other personal information you chose to include in your email. Additionally, CVT may refer to your personal information to better understand your needs and to assess how we can improve the CVT Sites. We try to answer every email in a timely manner, but may not always be able to do so.

i. Business Ideas or Inventions.This Privacy Policy does not protect you when you send business information, ideas, concepts, or inventions to the CVT Sites by email or by any other means of communication. If you want to keep business information, ideas, concepts, or inventions private or proprietary, do not send them in an email to or submit them through the CVT Sites.

4. Cookies and Non-Personal Information.

We also collect non-personal information about your use of the CVT Sites, special promotions and newsletters that we send to you. Like many websites, CVT uses standard technology to download small pieces of computer code on your computer's hard drive when you visit our site. These files are called "cookies". They are managed by your browser and are used as devices to aid in navigation each time you revisit the CVT Sites. If you wish, you can disable cookies by turning them off in your browser, but if you reject our cookies, certain of the functions and conveniences of the CVT Sites may not work properly.

We do not use cookies to identify you personally in any way, but they do let us gather general traffic pattern and site usage information. Cookies allow us to know how often someone visits the CVT Sites and the activities they conduct while on the CVT Sites (such as the pages visited). For example, cookie technology allows us to collect "clickstream" data, which is not personal information, but which reflects your activities on the CVT Sites, including your interest in certain health care conditions. This allows us to continually improve the CVT Sites for our users. Even though CVT collects such information via cookies, we will not sell, trade, lease, or reveal this information to any third-party, except as provided in this Privacy Policy.

CVT also collects other non-personal information in aggregate form relating to such matters as: the total number of visits to the CVT Sites, the number of visitors to each page of the CVT Sites, and the time spent on the CVT Sites. CVT uses this information, which remains in the aggregate form, to understand how our visitors use the sites so that we can improve the CVT Sites.

5. Access by Third Parties and Affiliates

We may share your personal information with agents, contractors or business partners of CVT in connection with services that these parties perform for, or with, CVT. Access to your personal information by these third parties is limited to the information reasonably necessary in order for such parties to perform their limited functions for the CVT Sites. Occasionally, we may share your information with a trusted third party in whose products or services we believe you may be interested. We contractually require that these agents, contractors, partners and other third parties 1) protect the privacy of your personal information consistent with this Privacy Policy, and 2) not use or disclose your personal information for any purpose other than providing products and services for, or in collaboration with, CVT. We may, for example, provide your information to agents, contractors or partners for hosting our databases, for providing data processing services, or for processing the information that you have requested. In addition, CVT has contracted with a third party to host the database where employment applications are stored. The third party has access to that data if necessary to perform its services, but is contractually obligated to protect the privacy and security of that data. Personal information about you will not otherwise be disclosed for marketing purposes without your permission.

CVT may share your information with our affiliates. We may also provide your personal information to a third-party in connection with the sale, assignment, or other transfer of the business of any one or all of the CVT Sites or the business to which the information relates, in which case we will take steps to require any such potential buyer to agree to treat your personal information in accordance with this Privacy Policy.

Personal information about you may be used and disclosed by CVT, its affiliates and its agents, contractors, or partners working on CVT's behalf, in a manner consistent with this Privacy Policy and as required by applicable laws, regulations, or other governmental authority.

6. Disclosure for Legal Reasons.

CVT may disclose your personal information if (a) we reasonably believe we are required to do so by law, regulation, or other governmental authority (such as reporting safety information to the Federal Food and Drug Administration) or to comply with a search warrant, subpoena, or court order; or (2) in special cases, such as a physical threat to you, others, or homeland security, in which we believe it is reasonably necessary to investigate or to prevent harm, fraud, abuse, or illegal conduct. Federal regulations require us to collect patient-identifiable information in order to file reports with the Federal Food and Drug Administration regarding the safety of our products, and as otherwise required by law. CVT may also use the information to contact the prescribing physician to follow-up regarding an unexpected event involving the use of our product.

7. Your Privacy Choices; Removal of Personal Information and Updates.

When you access any interactive tool or service on the CVT Sites, you may affirmatively choose whether or not to provide the requested information. You may always choose not to provide the requested information. At the time that personal information is collected, you are also provided with the ability to decline ("opt-out") having CVT email you information about CV Therapeutics or our products or services, to the extent that sending such materials is unrelated to the purposes for which you provided your information. In addition, you are also provided with the ability to opt-out of having CVT share your information with select business partners in whose products or services CVT believes that you may be interested.

Once you are registered to receive emails, promotions, announcements of new services and products, company information, publications, reprints of materials, or newsletters on particular topics, you may opt-out of receiving any future information as originally requested. For any requests to opt-out of receiving future materials either from CVT or our business partners, you may email CV Therapeutics at webmaster@cvt.com to let CVT know that you do not want to receive such materials from CVT and/or our business partners. CVT also provides you with the ability (a) to delete any personal information or health-related personal information you have provided to us, and (b) to review, correct, and/or update any of the personal information or health-related personal information that you have provided to us. In order to do so, you may access your account or registration or you may email CV Therapeutics at webmaster@cvt.com. Please be aware that CV Therapeutics may not comply with a consumer's request to amend information that was provided to CVT by a healthcare provider or a consumer regarding an adverse drug event.

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to the CVT Sites from CVT's servers. The need to back-up our systems to protect information from inadvertent loss means that a copy of your personal information or health-related personal information may exist in a non-erasable form that will be difficult or impossible for us to locate. Nevertheless, CVT agrees that upon receiving your request, all personal information and health-related personal information stored in the databases that CVT actively uses for research and daily business activities, will be deleted.

8. Consolidation of Data.

Consistent with the purposes identified and standards set within this Privacy Policy and other applicable privacy notices that have been provided, in some cases CVT consolidates and uses personal information that individuals share with CVT through various services and channels (such as the telephone, surveys, the CVT Sites and other online resources and communications), in order to enhance the quality of services that we offer.

CVT may track the total number of visitors to the CVT Sites, the number of visitors to each page of the CVT Sites, IP addresses, and the domain names of our users' Internet Service Providers. In addition, CVT may analyze this data for trends and statistics in the aggregate, but such information will be in aggregate form only and it will not contain personal information. Such aggregate information is not linked to any personal information that can identify any individual person.

CVT may use such aggregate information to analyze trends, to administer the CVT Sites, to track user's movements, and to gather broad demographic information for aggregate use. CVT may share this aggregate information with our corporate partners and contracted vendors to assist us in operating the CVT Sites and to enable them to better understand CVT's business.

9. Information Provided to Company.

As a user of the CVT Sites, you are liable for the accuracy of the information that you provide to us, including, but not limited to, your professional representation, and any information provided on any resume, cover letter or other material submitted to the Careers at CVT site. Other than the protections set forth above with respect to personal information, health-related personal information, or other information, specifically requested by CVT, the submission of any unsolicited information (such as the substance of questions, comments, suggestions, or other information provided to CVT) either through the CVT Sites or by any other means of communication, shall not be treated by CVT as confidential. CVT shall have no obligation to you of any kind with respect to such information.

10. Minors.

You should be aware that this site is not intended for, or designed to attract, individuals under the age of 18. You must be 18 years of age or older to submit registration or survey information. We do not collect personal information from any person we actually know is an individual under the age of 18.

11. Third Party Privacy Policies.

As a resource to our visitors, the CVT Sites provide links to other sites that are not owned or operated by CVT. Any links to a third-party website that you see on the CVT Sites are provided for your convenience only. This Privacy Policy does not apply to those third-party sites. Your use of these third-party websites is subject to the respective terms and privacy policies located on the linked websites. CVT cannot guarantee the standards of every third-party website link we provide, cannot be responsible for the privacy practices, and cannot guarantee the content included on these third-party websites. We suggest contacting those third-party sites directly for information about their privacy, security, data collection, and distribution policies. Remember, the statements in this Privacy Policy apply solely to the information collected by CVT.

12. Security.

CVT will take reasonable steps to protect the personal information and health-related personal information as it is transmitted from your computer to CVT's online resources and servers, as well as to protect personal information and health-related personal information in CVT's possession from unauthorized access, disclosure, alteration, or destruction. Please be advised that although we have tried to make the CVT Sites secure and reliable for you, the confidentiality of any communication or material transmitted to/from the CVT Sites cannot be guaranteed. We urge you to exercise caution when conveying personal information and health-related personal information over the Internet. It is your personal responsibility to secure your own copies of your passwords and related access codes for our online resources. You should also recognize that your use of the Internet and the CVT Sites is solely at your own risk.

13. Future updates.

CVT may make changes to this Privacy Policy in the future. CVT reserves the right to modify, add, or remove portions of this Privacy Policy at its discretion. If we decide to change the Privacy Policy, we will post new information on this page for your convenience, so you are always aware of what personal information CVT may collect and how CVT may use this information. CVT encourages you to review this Privacy Policy regularly for any changes.
